Medical Devices and Drugs:
Patients trust their health and safety to the makers of drugs and devices. They rightly expect that products have been properly tested and have passed all types of screenings to make sure they are safe prior to being placed on the market. Unfortunately, for some products, this is simply not true. All too often we find that the top priority of drug and device makers is profit, not patient health. Rather than readily investigate potential safety problems, they are slow to examine and even slower to admit a device or drug is defective or dangerous.

Whistleblower Claims:
Someone who has first-hand knowledge of fraud or other wrongdoing may have a whistleblower case. A whistleblower may sue on behalf of the government when they have knowledge of fraud, waste and abuse in government programs, and may be eligible to receive a portion of any money recovered by the government, up to 30 percent. Before reporting the fraud, it is very important to secure all proper and legal documentation, and make sure there is a valid claim under either the federal or a state’s False Claims Act. It is advisable to talk to an experienced whistleblower lawyer before filing any claim or reporting the wrongdoing. Personal Injury, Death and Product Liability:
Usually these claims assert that the person’s injury or death has been caused by the negligent or wanton conduct of another. The most common types of personal injury claims arise out of traffic accidents, accidents in the workplace, assault claims, accidents in the home, aviation accidents, nursing home neglect, and sexual abuse. When people are injured or killed by an unsafe, defective product, they may have a cause of action against the manufacturer, supplier, distributor or retailer of that product. Toxic Torts:
The major focus of Toxic Torts litigation is protection of individuals and their property from toxic chemicals. Exposure may occur over a long period of time at low doses, or serious injury may occur in a single incident involving a high concentration of chemicals or other toxins. I am especially concerned about severe lung injury or disease resulting from chemical or other toxic exposure, or a cancer diagnosis related to toxic exposure. This may occur in the workplace or as a result of environmental exposure from hazardous chemicals. For example, benzene exposure has been linked to the development of myelodyspastic syndrome (MOS) and Acute Myeloid Leukemia (AML.). Many times, someone who has received a diagnosis of MOS or MAL may not realize there is a connection to toxic exposure, especially benzene. Someone who has worked in industries such as petroleum, rubber, railroad work, or painting has a high likelihood of chronic exposure to benzene or other carcinogenic toxins and may have a legal claim. I also handle cased involving Government Environmental Litigation and Environmental Disasters, such as the BP Oil Spill. With my prior experience as a Judge for the Alabama Department of Environmental Management, I have a thorough understanding of what is needed to successfully pursue these types of claims.

Consumer fraud litigation includes individual cases as well as class actions that have been filed throughout the country.
